HOUSING DEVELOPERS (CONTROL & LICENSING) REGULATIONS, 1998

The Housing Developers (Control & Licensing) Regulations, 1998 set out procedures on how to apply for a developer's license as well as advertising and sales permits, on the form of sales contract to be used, on the administration of the Housing Development Account plus penalties for offenders.

APPLICATION FOR LICENSE

An application for a housing developer's license has to be made using Form A. The fees charged per annum arc as follows:

1. RM500.00 for a license to develop housing project more than 8 units but not more than 20 units.

2. RM1000.00 for a license to develop housing project more than 20 units.

A license is required for each housing development and where the development is carried out in phases, a license is required for each phase. An application for a license renewal must be made using Form C and the fees are similar to fees charged for a license.

ADVERTISEMENT & SALE PERMIT
No advertisement or sale is allowed without in advertisement and sale permit from the Housing Controller. An application for an advertisement and sale permit needs to made using Form D. The fees for the permit are as follows:

1. RM150.00 for housing project more than 8 units but riot more than 20 units.
2. RM250.00 for housing project more than 20 units.

An advertisement and sale permit is required for each housing development or each phase of the development an application for a renewal of any advertisement and sale permit shall he made using horns F and the fees arc similar to the fees charged above.

FORMS OF CONTRACT OF SALE
Two standard types of Contract of Sale for the sale and purchase of housing accommodation are prescribed in the Regulations. One is for the sale and purchase of a housing accommodation in a subdivided portion of land (landed property) while the other one is for a housing accommodation in a subdivided building (strata title) .

The signatures to the contract can only be attested by an advocate or a person authorized by the Controller.

HOUSING DEVELOPMENT ACCOUNT (HDA)
In cases where a Housing Developer is ordered to open a housing Development Account (HDA) with a bank or, a finance company, the developer will have to comply with the order within 14 days and submit a certificate from the bank or finance company that the Account has been opened to the Controller.
